Our Wills and Probate Team are here to help.  They provide a practical, professional and compassionate service.

How much will it cost to make a will?

Our fees cover all the work required to finalise your Will.  This will include an initial meeting where we will take your instructions.  We will then prepare a draft Will and send it to you within 7 days of our meeting.  Once you have approved the draft we will then arrange a further appointment for you to sign the Will and any supporting documents.

Our costs for preparing the majority of Wills are as follows:-

  • Single Will (for one person):                          £145 including VAT
  • Mirror Wills (for two people): £225 including VAT
  • Trust Single Will (for one person): £280 including VAT
  • Trust Mirror Wills (for two people): £360 including VAT
  • Notice of Severance: £60 including VAT
  • Land Registry Office Copies (per title): £3

If your circumstances are more complex we will discuss this with you at our initial meeting and provide you with a full quote for the work to be carried out.

How much will it cost if I need Lasting Powers of Attorney?

Our fees cover the preparation and registration of the Lasting Powers of Attorney.  We also provide your attorney’s with advice and guidance in relation to their roles.  We will arrange an initial meeting where we will take your instructions.  We will then prepare the draft documents and send them to you within 7 days of our meeting.  Once you have approved the drafts we will then arrange a further appointment for you to sign the Lasting Powers of Attorney.  We can also meet with your attorneys for them to sign the documents or we can post the documents to them.  Once the documents have been signed by all parties we will register the documents with the Office of the Public Guardian.  The registration process usually takes between 8 to 10 weeks.

In addition there is a registration fee of £82 per Lasting Power of Attorney.  A reduced rate of £41 or a full exemption can apply depending upon your financial circumstances.

How much will it cost for me to arrange a Deputyship?

Ours fees cover all work required in respect of a Deputyship application to the Court of Protection.

For a straightforward application the Court fixes Solicitor’s’ costs at £1,020 (including VAT.)  However, if the application becomes contentious or additional work is required we would discuss our costs with you and either agree an additional fee for the extra work required or we can arrange for our costs to be assessed by the Court.

The court application fee is £371. In addition a medical certificate will be required.  The costs will vary but we will obtain a quote before the report is carried out.

On average it can take between 6 to 9 months for a straightforward Deputyship application to be finalised.

How much will it cost and how long will it take to administer an estate?

Our Probate team can tailor our service to meet your needs.  It may be that you simply want help dealing with the application for the Grant of Representation or you may want us to deal with the administration of the estate from start to finish.  Whatever your requirements we will be able to assist.

The work required will depend to a large extent on the complexity and range of assets and liabilities in the estate and the amount of assistance beneficiaries and personal representatives require from us. If a dispute arises between beneficiaries our costs will increase.  If the estate is a taxable estate for Inheritance Tax purposes additional work will be required.

Each estate is individual and unforeseen work often arises as the administration of the estate progresses.  It is, therefore, very difficult to give an exact timescale at the beginning of a matter.

 

Where an estate has:-

 

  • no more than 2 Executors;
  • a valid will;
  • no more than one property;
  • no more than 4 bank or building society accounts;
  • no other intangible assets;
  • no more than 3 beneficiaries;
  • no disputes between beneficiaries on division of assets;

no inheritance tax payable and the personal representatives do not need to submit a full account to HMRC and

  • no claims made against it;

We anticipate that it will take between 8 and 10 hours work to administer at  a cost of £270 per hour inclusive of VAT and therefore our basic costs would be between £2,160 and £2,700 inclusive of VAT.

In addition to the costs set out above, we will charge a percentage based on the gross value of the estate to reflect the level of responsibility in dealing with the administration.

  • Above £500,001 5%

 

In an estate where the Executors are partners of the firm

  • £125,001 – £500,000 5%
  • Above £500,001 1%

 

As a general guide, the key stages for the estate administration process are as follows:-

 

  1. Obtaining the Grant of Representation
  2. Collecting the assets once Grant of Representation is received
  3. Preparing the Estate Accounts and distributing the Estate

 

On average estates of the size described above are dealt with within 6 to 12 months.

Fixed Fee Probate

 We also offer a fixed fee for preparing the application for the Grant of Representation.  We ask that you provide us with full details of the assets and liabilities in the estate and we will then prepare the application and inland revenue paperwork and go through the application with you.

Our fee for this is £900 inclusive of VAT where no Inheritance Tax is payable.

Disbursements

Some additional disbursements may also be payable.  These are the costs, payable to third parties, which can arise when dealing with the administration of the estate for example:

 

  • Probate Fee of £155
  • Additional copies of the Grant of Probate £1.50 per copy
  • Statutory Advertisements of approximately £200
  • Land Registry Office Copy fee £3.00
  • Bankruptcy Searches in the UK £2.00 per beneficiary
