Probate and Administration of Estates

If you have been appointed as the Executor of someone’s will then you will need to ensure that all their assets are dealt with and distributed in accordance with the terms of the will.
If the deceased had not made a will (known as dying intestate) the situation can be more complex as the law directs who the estate will pass to. We can provide you with advice on how the estate should be distributed.
In order to be able to deal with the assets in an estate, such as bank accounts, shares, insurance policies and property it is often necessary to obtain either a Grant of Probate (if the deceased left a will) or a Grant of Letters of Administration (if the deceased died intestate).
At the same time an Inland Revenue form will need to be completed detailing the assets in the estate and if Inheritance Tax is due it will need to be paid before the Grant is applied for.
Once the Grant has been issued by the Probate Registry the assets in the estate need to be encashed or transferred, the tax position can be finalised and the estate distributed.
